Karl points us to the news that the advocates of the people who have sued by Right Haven, a Dana Eiser, submitted to what can only be absolutely epic answer and counterclaim complaint in the case in South Carolina are described, creating an amazing 56 ( count 'em) defenses. The 119-page filing, which is embedded in reading. When Karl emphasizes some of it is pretty far out (with some parts that just wrong), but it is entertaining reading, with some new and some interesting claims about Right Haven 's actions.

Get the point that 's a lot of attention is the fact that the filing of an extortion represents indictment Right Haven under the RICO Act and claims with bogus copyright transfers people shakedown for money is good, old-fashioned extortion:

All in all an entertaining read, but most of the really out there arguments are unlikely to get very far. However, if they did get some traction, Righthaven could be in even deeper trouble.

See Capitol Hill to be a beautiful place, okay? There are interns trying to please, lobbyists interested in your meal, why would you want to leave anyway? Unfortunately for the U.S. congressmen and women are the Schleps who elected them to get face time with their supposed representatives, which means a regular shuttle service in the way of some crucial foot massages and aromatherapy treatments. Do not worry, but Skype has come to the rescue. Microsoft 's latest acquisition is a seal of approval from the House of Representatives, has allowed members of Congress to use it to interact with constituents, attend virtual town hall meetings, and together with other members of the house. All the legislature makes fun aside, this strikes us as a step in the right direction and Skype promises that it 's homework done to keep the communication secure. Let 's hope so.

jrWhile so-called "three strikes" laws have been adopted in several countries in order to repeatedly accused of copyright infringement on the Internet kick Cnet is reporting that some U.S. ISPs

Sources say a final agreement has not been hammered out, but the preliminary rules are looking grim. The plan is being called a "graduated response", and ISPs would be given some leeway in how they administered it. It would start with written warnings. If the behavior continues, a user may have their bandwidth throttled, their service suspended, or their access limited to just the top 200 websites online. Presumably, the jack-booted thugs would be sent to a subscribers house in the dead of night at some point, but we cannot confirm.

The U.S. Supreme Court has ruled that an attempt by California, the sale of violent games to children was unconstitutional ban. We consider the factors involved and why this isn 'ta clear victory for free speech

On Monday, something happens, Arnold Schwarzenegger, that he rarely experienced in his films. He lost. In 2005 while still governor of California, the star of the Predator and Terminator Co signed a bill that would ban the sale of violent video games to minors in the state.

The game industry, by the Entertainment Merchants Association opposed, and on Monday, the U.S. Supreme Court ruled that this law was a violation of the First Amendment. After the decision, Justice Antonin Scalia said: "Even if the object of protecting children, subject to the constitutional limits of state action".

Of course, the decision with barely contained enthusiasm of the games industry welcomes. The Entertainment Consumers Association said it was "enthusiastic," said the Entertainment Software Association, it "a landmark decision" and Electronic Arts CEO John Riccitiello said game site Politics:

Everyone wins in this decision - the Court upheld the constitutional rights of game developers, adults reserve the right to decide what 's appropriate, in their homes, and shop owners can sell games without fear of prosecution.

"If the ban was enforced, the increasingly popular 'freemium' business model for game publishers would have been jeopardised. For this business model to work, players need to be able to access a sample of content without going through a restrictive age-verification process, and without having to provide credit card details up front (unless children know their parents' credit card details, this requirement might also otherwise prevent access by children to inappropriate content)."

The one certainty is that, although this ruling is an important milestone for the games industry in the US, it's unlikely to shut the door on future legislative efforts. It also raises important and uncomfortable questions about the whole concept of free speech in the digital era. This is a victory for the games industry, but its consequences and meanings remain uncertain.

Space nerds, get your browser ready - soon UrtheCast streaming of HD video on Earth right from the ISS. The system actually consists of a pair of cameras, a still and a video that can be mounted on the arm of the Russian station. The still pictures are very wide, about 30 miles per with a 18-meter pixel resolution. Much more exciting is the three-meter per pixel 3.25fps stream video, running 24 hours a day, seven days a week. Probably see you won 't be able to even waved as the ISS is overhead, but you should be able to place your Carton continues House. The feeds won 't your typical boring NASA tariff either - you' ll look to successfully rewind, and day objects or events, and UrtheCast offers APIs for developers to build on the service. The project won 't bring the market to 28 June, so bide your time by the video and PR after the break.

postheadericon Did Congressional Debate Over Patent Reform Bill Open Up A Backdoor For An Independent Inventor Defense?

I have to admit that I had almost entirely checked out on the House debate this week on patent reform. I've been writing about Congressional attempts at patent reform for nearly a decade now and, from the very first attempt onward, the proposals had serious problems -- and each year the bill would get more and more watered down, removing what few good pieces were in there, until we got the bill this year, which had little of substance. As we noted when the Senate approved it, the bill was pretty useless in that it didn't address any of the actual problems with the patent system. There was a flurry of activity this week as various Reps sought to make changes to the bill (and I've never been contacted by so many press reps or Congressional staffers wishing to get publicity for their boss's amendment than this week), but nearly all of those proposals failed.

Honestly, seems like a piece (and if taken literally, might call into question whether someone but authors and inventors could hold copyrights or patents. That said, those in support of the "first inventor to file" setup made some interesting statements:
Rep. Jerrold Nadler (D-NY) said the draft law still requires the patent-seeker to inventors, and argued that the Constitution does not explicitly on how to ensure patent rights, Congress must. Rep. Bob Goodlatte (R-Va.) agreed.

"This is the first inventor of file" Goodlatte said. "You must qualify for a bona fide inventor for this." Both Nadler and Goodlatte are on the Judiciary Committee.
Now that is pretty interesting. Because in the past, we 've suggested that what the patent system really needs, is an independent invention defense - so that those who come with things not completely independent of the patent in question guilty of the violation. One of the main arguments against this idea, if we 've it to put is that it' s "not as something" as an independent invention, because once something 's invented to get someone else with the same is

Many large organisations use databases with known security holes that can easily be exploited by anyone who has recently completed the first year of a computer science degree: it's no coincidence that so many of these hacker collectives appear towards the end of the academic year.

For that reason, the members of LulzSec are either modern-day versions of Ars?ne Lupin, Maurice Leblanc's fearless gentleman thief for whom the risk of capture was part of the thrill, or they're absolute, grade A imbeciles (spoiler alert: it's the second one). We've all seen enough movies – which is to say, the first 10 minutes of Sneakers – to know what happens when you mess with the UK government. Any day now, in Wales or Warsaw or Wasilla, a spotty kid in a V for Vendetta T-shirt will be dragged from his parents' house at gunpoint and bundled – sobbing and pleading that it was all a joke – into the back of a van.
