Authors Guild's Scott Turow: The Supreme Court, Google, Ebooks, Libraries & Amazon Are All Destroying Authors
However, in its most recent York Times opinion piece, which is basically wasted all his cluelessness together in an incoherent mess "and another thing" with his desire these tech guys nuts of your lawn. A few thousand members of the Authors Guild, it's time to find someone who was actually a visionary to drive, rather than a technology hating reactionary nostalgia for a mythical past time.
first, the confused reaction to the protection of rights of first sale in Kirtsaeng the Supreme Court.
last month, the Supreme Court decided to allow the import and resale of foreign editions of American works, which are often less expensive than national issues. So far, the courts have banned this activity as a violation of copyright. This not only opens the door to an increase in cheap imports, but since it will be sold on a secondary market, the authors do not receive royalties. First, no, it was not a "change" in U.S. law. Courts have banned this particular situation in the past, due to the specific characteristics of this fact had not been tried in the past, apart from a few recent cases have slightly different factual situations. The point of the decision of the Supreme Court was to reinforce what most people already believe that the law is that if you buy a book, you have the right to resell.
As for the "surge" of cheap imports, we will wait and see. Could affect markets, such as textbooks, which artificially inflates, but regular books? It seems that much of the thinking that would be profitable to ship in foreign books for resale. And, of course, secondary markets have existed for centuries, and studies have shown that actuallyhelp authors, because it makes it less risky to buy a new book because that people know they can sell. Turow admits that secondary markets have always existed, but it skips that this is "really" about in his mind: This may seem a minor issue, the authors deal with a huge internal market of used books. But it is the latest example of how the global electronic market quickly depletes the revenue of the authors. It seems that almost all players - publishers, search engines, libraries, pirates and even some academics - are vying for the position at the expense of the authors.
Yes, it's true. Kirtsaeng The decision is not only the first sale, it's really over evil "electronic marketplace" suck dry authors. Of course, no mention Turow Kirtsaeng had almost nothing to do with the Internet. Yes, Kirtsaeng ended up selling their books on eBay, but a lot of books for sale on eBay. This had an impact on the decision at all. The question of the decision was legally acquired books abroad, and made without the Internet Kirtsaeng - you just have your friends and stayed in Thailand to buy books for her family. Blamein "global electronic market" is completely random and evil. Looks like the kind of thing someone says they want to blame technology for all. Turow has his hammer against the technology, but we must stop looking finger on it.
that
Authors
practice one of the few professions directly protected by the Constitution, which requires Congress "to promote the progress of science and useful arts, by securing for limited times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries. "The idea is that a diverse literary culture, created by the authors for their livelihood, and therefore independence, can not be threatened, is essential for democracy.
grants Specific Congress
Turow is a lawyer. Therefore, I hope that it does not alter what the Constitution says, but did here. Authors are not "directly protected by the Constitution." The Constitution does not "load" the Congress to create copyright to promote progress. Article 1, Section 8 of the Constitution
powers
about thiscan
do. No. "educate" Congress must do these things. The same article of the Constitution gives Congress the ability to "grant letters of marque" privateers ("pirates" at sea) to attack enemies. No one can deny that the Constitution "load" Congress allow pirates off to "attack and capture enemy ships." In fact, Congress has not officially used power since 1815. Similarly, it is not necessary for Congress to "protect" the authors in this way, no matter how Turow can argue that this is the case.Frankly, Turow will distort the Constitution to require when he must know what he says is true. I really wondered why the New York Times allows these false statements openly go with your name.
publishersproduce books. Turow apparently ignores the fact that these modern technological wonders (who hates both) led to a whole new world of successful self-published authors who take advantage of this situation to realize that they have editors, and the low cost and ease of distribution makes things much easier. As Clay Shirky has said in the past, the issue is a button, not an industry. And no, it does not mean that all authors must do for themselves, but the problems in marketing, not "publish" or distribution (relative to ebooks). also the idea of ??a literary culture is laughable at risk. More books are published today than ever before. More people read books than ever before. More people write books than ever. The books that have never been published in the past are regularly published today. There is an incredible wealth of cultural diversity in the literary world. Sure, some of them means more competition for the small group of authors (only about 8000 or so) that Turow is ... Oh wait, I think I hit why Turow is upset about it. But, of course, more competition for this small group of authors does not mean that the book culture and literature is in danger. Quite the contrary.
But instead of using the savings to be more generous to the authors, the six major publishers - five of which were prosecuted last year by the Antitrust Division of Justice for fixing e-book prices - All rigidly insist on restrictive clauses ebooks royalties to 25 percent of net income. This is about half a traditional hardcover royalties.
authors required and have the market power to negotiate a fee cease-book and implicit in our growth, but our editors will not admit it. But the writers whose works sell for less robust profits are down because of the new rate, a process that will accelerate as it rotates to the digital market.Again, this is not totally new reality. Authors who do not like the deal certainly bad for the big publishers
can go to alternative
. They can self-publish. Or you can register for a new generation of intelligent digital publishers are much more like Goalkeeper partners. No wonder Turow does not even seem to know these things exist. Hell, last week we talked about a self-published author successfully take advantage of its great success in a very favorable deal with Simon and Schuster to manage the distribution of physical books. And a week after Scott Turow argues that only historical bestsellers, as it can negotiate better rates with major publishers 6 to New York? Awake, Scott, there is a new world out there that you seem to ignore.
famous Barry Eisler turned down a half a million dollars with an editor, because he realized that the economy was much better to go all law. Many authors recognize that now influence that used to have none. Turow seems strange that not even recognize this reality, assuming instead that the perpetrators are still stuck in the system in which the only way they can get to be published is to take a bad deal with a publisher.
And there are many e-books in which authors and publishers, large and small, do not earn anything. Many pirate sites, supported by advertising or subscription fees were increased to the sea, offering old and new free ebooks.
If you're a writer without winning anything at all, then you have more problems than technology. Probably means that you are in darkness, and nobody knows who you are. In addition to this, is that you have done nothing at all to connect with their fans. We have seen authors actively encourage piracy of their books, but also work to connect with their fans, and we saw sales increase, because the fans want to support the authors. In addition, as most people know (why not Turow seems to know?) Ebook "piracy" is a rather small market, in part because the initial market was dominated by the Amazon Kindle and the editors wisely jumped edge. Yeah, not piracy e-book, but not like the music industry and film where officials essentially given every year on the market of piracy.
Pirates
be a limited threat if not for search engines to direct users to these sites without scruples, without fear of legal consequences, thanks to a provision introduced in copyright 1998. A search for "Scott Turow free" e-books increased by 10 pirate sites outside the top 10 results from Yahoo, Bing on August 8 and October 6 in Google, with paid ads that adorn the margins of three pages.Well, this is just ridiculous. Firstly,
person
is looking for "Scott Turow ebooks free "so it should not be a big problem. I did a search on Google Trends" by Scott Turow free "against" Scott Turow books ebooks "and it shows personsearches for "Scott Turow free ebooks", so it does not have much to worry about. Frankly, it should probably be a hell of a lot more worried that few people seem to be looking for "Scott Turow books "either.
But the most important point here is that even if people
were
search "Scott Turow free e-books," How is it so important? By the fact that they do research in particular, have more or less self-identification as people are not interested in paying money to Scott Turow books, so they are not on the market anyway.
If I was in a corner to tell people who asked where they could buy stolen property and received a small fee for it to be on the way to jail . And yet, even when researchers sailing under slogans such as "Do not be evil", who do the same.
This makes no sense on several levels. All First, by their own figures, Google (using "Do not be evil") had the lowest number of "bad" sites in the results based on Turow. I did the same search and I had not really found a couple of sites that were potentially counterfeit. Instead, I saw links to the Authors Guild, Amazon, the Wikipedia page Turow ... and an old article on Techdirt Turow cluelessness. That said, one could say that if Google is "being bad" is really here
