postheadericon A Postgame On Canada's Copyright Reform

Monday, after several attempts over several years, the House of Commons of Canada passed Bill C-11 (formerly known by other names), a reform of copyright bill radical. The Senate approval is almost assured, and the bill is essentially certain to become law in the near future. Fortunately, unlike SOUP / PIPA United States, C-11 is

not

a bill ridiculous, draconian blocking Internet. In fact, there is much to celebrate in the law, even if overshadowed by the celebration is a major problem. The share of digital locks, which is similar to the fight against the circumvention of the DMCA
  • But first the good things. Michael Geist has an excellent summary of the C-11 with a comparison with the previous phases of copyright in Canada. The victories of the law of copyright smarter in C-11 sound almost as fanciful as compared to the debate on copyright in the United States. These include:
  • new provisions on fair (our version of fair use) to meet the educational uses, as well as the parody and Satire

new backup, reformat and the allocation of time travel that remove previous restrictions on the networking services and Internet TV DVR (similar to those who suffered in the courts of the United States )


explicit exceptions to "user generated content" of copyright is to protect non-commercial fan-art and remixes



A handful of explicit exceptions for schools, such as the right to organize public events
A system of notification and alert, not a system of notification and withdrawal capped at $ 5,000 in statutory damages for infringement Noncommercial
