Aaron Swartz case prompts letter to US attorney general from congressmen
Republican Darrell Issa and Democrat Elijah Cummings asked if the level of treatment Swartz was "appropriate"
members of Congress to Investigate the Persecution of Aaron Swartz asked U.S. Attorney General if the information militant advocacy free was a factor in the decision to prosecute.
A letter from Commission control of the House Eric Holder says that you take a close look at whether the level of criminal charges and penalties sought by prosecutors were appropriate and whether political factors have played a role.
Swartz committed suicide this month after battling federal charges against piracy, which has been severely criticized as too ambitious and unnecessary lawyers and experts on cybercrime.
A joint letter to Darrell Issa, Republican chairman of the commission and Elijah Cummings, the top Democrat, requested a briefing schedule for the staff of the Department of Justice in a week.
Twitter Monday that Issa had requested a "meeting timely information" on the case, with a link to the letter the first time by the Huffington Post.
Swartz, an Internet pioneer who helped create Reddit, faces 35 years in prison and millions of dollars in fines after being charged with 13 offenses for allegedly breaking into the Massachusetts Institute of Technology computer system to access a large volume of academic papers from JSTOR digital library with the intention of making it available for free. He had legal access to library items, but was accused of violating the terms of service by downloading more, too fast. JSTOR has not followed a chase after Swartz gave his files to the Ministry of Justice.
His family has accused prosecutors and MIT to contribute to his death on January 11.
- letter from Issa and Cummings, 28 January, asks what factors influenced the decision to prosecute Swartz, and what is behind key decisions in the case that multiple charges against companies and specific advocacy is offered.
- In particular, it asks: "Is the opposition Mr Swartz for soup or in association with groups considered"
lawyers Swartz said he had not been able to try to get a plea bargain that involved no jail. It has been proposed plea bargain of six to eight months in prison if convicted of 13 counts.
Issa was a staunch defender of freedom on the internet and decided against Sopa. Cummings told The Huffington Post that the Department of Justice decided to inform.
